I live in New York
In 1995 I was riding my bicycle
through Times Sq. on a Sunday afternoon.
A woman in her 70s ran out into
the street in pursuit of a bus.
While I managed to stop, she didn't --
she ran into the front wheel, lost
her balance, fell to thee payment
and injured her elbow.
I am now codefendant in a suit for
$2,000,000 -- the other defendant
is the NY Transit Authority.
There are a number of issues here:
first, though i had the right of way
and she ran out, there are no
witnesses besides the two of us.
The police report says she did
run into the street.
Second, her lawyer served me
(nail and mail) at
my mother's address. While I had
provided id with that address,
the lawyer had contacted me at
my residence (not my mom's)
prior to service.
I put in an order to dismiss
on those grounds, but it was
denied. The judge, who ran
the hearing as if we were on
an assembley line, said i had
'listed' this as my address and
that by putting in a notice
of appearance and appearing for
a deposition (both of which I
did after consulting the pro se
office and having them tell me
I had to) I had waived any right
on this matter.
The main problem is this --
I have virtually no money.
My net worth is negative $50,000
-- i have about $15,000 in
retirement accounts
and $65,000 in student loans
for a PhD which i'm still
working on.
If i hire a lawyer i'll be
thrown further into debt,
if i don't . . .?
And add a fourth matter --
i'm supposed to be moving
out of the country
starting July 1st.

for a couple of months, but
