i live in ohio. I never signed the lease for the house i rent now. can my landlord actually evict me? i was just going to let him keep the deposit as the last months rent, and he said no, if i don't give him money he will serve me eviction papers and it will go on my credit. originally i moved into this house with a former boyfriend. we broke up, he moved out, i stayed. i never signed any lease agreement with the landlord. where do i stand legally?

The landlord must give you a 30 day notice to move in writing...

THEN he can file for eviction in court if you dont move.....

You cannot use the deposit as the last month rent without the landlord approval.....that is the law in all 50 states!

BUT you also cannot use someones elses deposit for the rent either....since you are not on the lease, the ex boyfriend will be sued for any damages...or will get the deposit back.

UNLESS you and the landlord and the boyfriend signed an agreemnt to turn over the security deposit to YOU.
