hello, i am from michigan. my girlfriend had a daughter in july 2000 and i signed an affidavit of parantage but it turns out i am not the father of the child and i have a dna test to prove it. is there anyway a judge will order me to pay support anyways even though i have dna proving i am not the father?? please help asap.

I am in MI too and the court will not make you pay child support for a child that is not yours, as long as you can prove it. At least that was what F.O.C. told me. I would get your name off the birth certificate or what every you signed.

thanks for responding. i have a hearing on may 28 in front of a judge and i just dont want to go in there and have him tell me i am SOL because of an affideavit of parentage
 
Actually, because of the fact that you signed the Affadavit of Paternity acknowledging that you were the child's father, you are now legally named the child's father and you may still be ordered to pay child support until the paternity is disestablished. The paternity test results may not be what you need to have your name removed from the child's birth certificate until you can prove that the paternity between you and the child has been disestablished and you are no longer named the child's legal father. You need to contact an attorney and file a petition to disestablish paternity. Once the paternity has been disestablished then you may present the disestablishment of paternity order and the paternity test results to the Vital Records Department to have your named removed as the father from the child's birth certificate. If you have the DNA

saying you are not the father, then that is all you'll need. I am assuming that when signed the Affadavit of Paternity, you thought you were the father. And later, you found out the truth and now can not be held responsible. Mom needs to find out who the father is...

The first thing that matters is the Laws for your state. Some States have paternity fraud bills. Listen to the original poster. Do some research before you go before the judge. There are men all over the country that have DNA tests to prove they are not the father and Pay any way to these Paternity Fraud perpetrators. These Perpetrators just pick a guy based on income stabilty and moral responsibilty to get a free ride. Here is a website that will help you, email Carnell.
