Hi! I purchased a home in Michigan, March 1994. In 1996 when I requested that the PMI be dropped from my mortgage, the mortgage company dropped the PMI; however, they told me that I would have to purchase flood insurance immediately - that I was in a FEMA zone.
I would not have purchased the home had I known in was in a flood zone. I didn't know what to do, we liked the house and I spoke with a neighbor who told me that my home had never flooded.
So, even though I was very upset that no one at the closing brought this up - I didn't do anything. I did mention it to my real estate agent and she did not say anything - just surprised.
Now, that I think back on it - the lady has been selling in this neighborhood for 25 - 30 years - she knew it was in a flood zone. I knew that there were flood areas and even told her that I would not consider purchasing in one of the areas. Can't prove any of that, besides, I also told her I wouldn't buy a home with a pool and I did (like an idiot).
It's now 2/2000. I have put so much money into this house -- the seller disclosure statement is a farce (I'm right?).
I am in the process of remodeling two of the bathrooms and there is significant water damage (interior door frame) among other things. I am beside myself. The seller said they had a roof leak over the kitchen that they had repaired (I had the whole roof torn down and replaced - including all the wood)but they didn't mention that all of the kitchen cabinets were rotted out from water damage - they only lived in the home 14 months before they were transferred - I think that the water damage has been going on for many years.
I know that people don't get very far trying to prove that someone lied about something but, does anyone think that I can get something because of the FEMA thing? Should I bother contacting an attorney? Have I waited too long?
I am so upset. Every time I try to fix, repair or replace something, I have another disaster. The home was tested for absestos, radon...but I think the house is full of that too - I'm going to have it tested next week. Any recourse if they find out that the home does have this? Am I just paranoid?
Any information is really appreciated - Just don't wait too ling to respond - I amy be dead from absestos/lead/radon poisoning or all the toxic mold from the water damage
I am so sorry this is so long - just pulled out some more rotted wood and one of my cats died a few weeks ago and I thing it's because of this house.
