I Believe Therapeutic Privilege was used

I believe the er doctor I went to see used therapeutic privilege and discussed my medical treatment with an abusive ex boyfriend after I was put on a benadryl iv drip. I've requested my recoards but was sent the same papers over and over again and still can not figure out why I was given the iv drip of benadryl and the doctor has not contacted me when I've tried to go over the visit with him because while I was under i woke up a few time and overheard him discussing my treatment and diagnosis to my ex boyfriend and when I woke up the doctor was no where to be found. And this is not even the full story nothing about the doctor visit is adding up to me. I got a second opinion from a new doctor the next day and was confirmed I did not have what I was diagnosed with atthe er the night before. My question is how would I go about getting my recoards if the doctor did use therapeutic privilege? I ha e already filled outthe hippa form but the papers are the same as I got before and the visit still don't make since? Maybe I should ask how do I find out if he used therapeutic privilege.?

This doesn't make any sense. "Therapeutic privilege" is a term without any legal meaning. According to one online source, "[t]herapeutic privilege refers to the act of withholding information by a clinician, with the underlying notion that the disclosure of this information would inflict harm or suffering upon the patient." The example given was "a case of a 56-year-old woman who presented to [a] facility under critical conditions. She developed sepsis with acute respiratory failure, requiring intubation and mechanical ventilation. Prior to her admission, her husband had been admitted at [the] facility's intensive care unit. On the same day . . ., her husband had died. The palliative care team was consulted to assist with disclosing this information to the patient in light of her emotional fragility, her anxiety, and concerns for her ability to receive such news given her own active illnesses."

Based on that definition, a doctor could not "use[] therapeutic privilege [to] discuss[] [your] medical treatment with" someone other than you.


My question is how would I go about getting my recoards if the doctor did use therapeutic privilege?
The way to get your records from a medical provider is to follow the provider's procedure and pay the copying charges.

OK...so you've already requested and received your records. I don't understand what more you're seeking. Just because something doesn't make sense to you doesn't mean the provider is withholding anything. Perhaps you should have your regular doctor speak with the ER doctor.

And tell us why this is such a bad thing. Did your abusive ex boyfriend do something to you after this incident? Why are you trying to reach the doctor?

From experience, you can have some pretty loopy delusions while lying in a hospital bed getting an IV of something like benadryl. were you having a life threatening allergic reaction or asthma attack?
