I bought a 2000 Ford explorer last year from a Ford dealership, I was promised by the sales person that the car had never been wrecked.
It may help to know a little back ground. In fall of 2001 my wife and I were searching for a new vehicle. We went to a dealership and found a 2000 Chevy Blazer that we both liked. We took the vehicle home and found overspray under the wheel well and tape lines in the door jams. We immediately brought the truck back and refused to work with that dealership. They lost our business after attempting to sell a wrecked car as undamaged.
We then went to a Ford dealership down the road. We told the sales person of the deal we had just got out of and wanted to make sure that would not happen here. The sales person swore up and down that the Ford Explorer we were interested in had never had any damage. We took the vehicle home for the weekend, I crawled under the vehicle and checked the door jams (as much as a non-mechanic can do). The Explorer ran great other than a slight vibration in the front end. The sales person assured they would balance the tires and that would take care of hte problem. We purchased the vehicle.
Over the 1 year we owned the vehicle we brought it to the shop appx. 4 times for vibration in the front end. Replaced ball joints and bushings. The last time they said we needed to get new tires (40k miles later and the tires were due to be replaced) We purchased 4 new tires.
While cleaning the vehicle I had noticed there was broken glass pieces in a cubby hole where the jack is located. It made me cautious so I searched a little more. There was also a tape line where the rear quarter panel was painted. I immediately called the dealer. They acknowledge that the car has in fact been wrecked and they have it in the shop right now. He called me and let me know that the car had been damaged and asked me what he can do for me.... I do not know what I am entitled to. I am sorry for the long story, but I really need to know what I should do. Don't forget, we have had this vehicle for over a year now and have put 40k miles on it. I also purchased the extended warranty offered by the dealer which is good until 100k miles. Thank you.
I did a car fax and it reported no damage.

Q: Had I known the car was damaged, I would not have bought it. Is this a breach of contract?
