I don't know what to do. I was a salaried employee for nantionally recognized pizza chain and was hospitalized for a sickness(Influenza).The first time i was hospitalized back in Dec. of 07, I was paid my full salary for the time I was in the hospital. when I was hospitalized just 2 weeks ago my employer docked my pay for some of the time I was hospitalized. I was paid for the first week i was there but when I received my most recent check which was also from when I was in the hospital, my employer didn't pay me what I was expecting to get paid,but only paid me an hourly wage for the time when I went back to work. I was expecting to get paid my full salary, for the time I was in the hospital, as I was paid before. Can an employer do that? My supervisor told me, after the fact, that if I didn't work 48 hours a week that I would only get and hourly wage, but he didn't inform me that I wasn't going to get paid my regular salary at any time during my hospital stay. Now I don't know what I am going to do. I have no money to pay my rent or any of my other bills because I didn't get the pay that I was expecting. what do I do?

Salaried is only a pay method. What matters is exempt or non-exempt.

If you are non-exempt, then you never have be paid when you do not work.

If you are exempt, then your pay can be docked under certain circumstances. One of them is if your employer offers a reasonable number of paid sick days, but you have either used them all or are not yet eligible for any at the time you are sick.

If you used all your sick days during the first absence, it is legal to dock you for the second.
