I live in Colorado. I just got served tonight by a collection agency trying to collect on an unpaid doctor's bill. I had just mailed out the check for this bill earlier in the morning. Since the bill is in both my husbands and I's name there are two attorney summons. I do not dispute the charge, the doctor does need to be paid, but what do I do now. I had mailed the check to the collection agency. Do I call there lawyer and tell them that or do I still have to file a response in the court house, and do both my husband and I have to file seperate answer at court since we received two attorney summons. Can this process be stopped by their attorney before it goes any further?

Was the filing in Small Claims court??
Was the payment sent for the FULL amount claimed??

If so, then respond to the lawsuit(s) with a general denial, that the claim has been paid in full and ask that the Plaintiff be forced to prove their case. By the time the case is heard, you should have your copy of the check back from the bank to show the court.

The paper doesnt say if it is small claims court, just that I need to file an answer to this attorney summons or a judgement might be filed. It was for the full amount. My question is do my husband and I have file seperate answers since we each got one with just our names on it? One for him and one for me.

if you both were served you both need to file an aswer if not the one who does not answer may loose by default
just put the same answer on both papers
