I got side swiped...What can I do

I live in california. I was in kragens buying motor oil for my car. As I get back in my car I lok back behind me and there are no cars in sight, so I start to back out. Im almost out and then the next thing I know I get hit. A driver driving a white Ford Explorer hits the back right of my car so hard that my car spins around and the front right of my car hits his side, my car spins around about three more times and then gets wrapped around a sign. The damage is about $4,500. Not to mention that some parts are not replacable because it is an after market car. The driver hit me and was going at an unsafe speed. Then he gets out of the car after the accident and has the never to show me his headlight. THE ONLY THING DAMAGED ON THE CAR WAS A HEADLIGHT. He was mexican and did not speak english to well. He told me he would be right back and was leaving, but as he was leaving I took a picture of his license plate. He didnt come back for about a half hour. Then when he finally came back he came in a different car with his friend. NOT EVEN THE CAR HE HIT ME IN. There was a witness that told the police that it was not my fault and the driver was going at an unsafe speed. My back is killing me and I want to get as much money for this as possible.

The police report comes out tomorrow, but from what I was told by the police (before they found a witness, dont know if it changes everything) was that no matter what the person backing out is responsible. Which i believe is total bull**** because i did look back and i couldnt see him because when i was backing out he was around a corner, took it at an unsafe speed and hit me at an unsafe speed. Also I do not know if this matters but since kragens is private property the police acted as if they were doing me a favor taking the report. WHAT CAN I DO?

Correct. But turn it over to your insurance company and let them handle it.
