Hello, I need some advice, as I've never sued anyone before. Back on September 30th, I was on a flight from Dallas TX, to Los Angeles. I'm relocating here for school, and work, temporarily for about 3 years. As It was a connecting flight all the way from Philadelphia, I've never flown across the southwest, and I requested a window-seat for the view, mountains, desert etc. As I made my way to my window-seat a "plus size" woman was in the seat next to mine. She asked me in a polite tone if she was cramping me and if I needed more space, I was actually fine and said no, i'm okay. She however, said that she didn't mind and there were at least a dozen open seats in the center of the aircraft. I said only if you want ma'am. So approximately 5 minutes later, she asks an extremely nasty male flight attendant if she could move to give this gentleman more space, referring to me. As she's saying this I was actually looking out of the window, i then here in a loud, obnoxious voice, this ignorant animal say, "what's wrong didn't shower today or something?'' I turned to look if this ridiculous thing was being said to me, and it was! I got the degenerate's name and employee number and complained at LAX. I also filed a formal complaint with American Airlines over the phone, which they're currently "investigating." I opened a BBB complaint as well about this matter, and time is dragging on. It's been nearly a week and i want satisfaction. Could someone please instruct me, how and what to sue for? This incredibly offensive remark was said to me loud enough to make the "plus size" woman blush and several people surrounding us heard it and were shocked. I'm a clean, educated man, not someone that's used to being insulted like that. I believe it falls into the category of defamation or slander, or perhaps some sort of harassment? I'm not sure, my education is in marketing. I want to sue, asap. Thank you and if you're in the Los Angeles area and want to take this case, I'll provide contact information wherever I can on this site. Thank you.

That is not actionable. You can sue but you don't have a claim upon which you can proceed.

The BBB has no power to do anything. All any complaints do is sit in a file presuming that the organization you are complaining about cares to do anything to resolve it. Complaints made over the phone are rarely "formal." You are not legally entitled to anything because someone ELSE was defamed. Someone being rude is also not actionable.

Write a complaint letter to his boss. Don't expect any compensation since you were not damaged. Some people are jerks, get thicker skin.

This is the part where you learn there are mean people and sometimes they will say mean things.

I think your bridge is lonely. Best go back there.

I'm not sure you can truthfully claim that you have an education, by the way. Wait - does that mean you're going to sue ME, too?!

Only if you are an offensive, obnoxious, ignorant, nasty, degenerate animal, Proserpina. ;)

I had made a post to this thread earlier and then deleted it, because I thought it unnecessary. My suspicions about the "lonely bridge" were as yours are.

But, should RyanVCampbell return and he is the "educated" person he claims to be, he should probably know that the flight attendant probably has a better claim for defamation against him than he has against the flight attendant. Implying someone has not showered is not defamatory, it is just not very nice. Implying or stating to others that someone is not suitable for their job or profession can be defamatory per se, if the facts do not support RyanVCampbell's version of the truth (not that I think it likely any defamation claim will arise from this tale of an unhappy traveler).

I hope for RyanVCampbell's sake that he is either an under-bridge dweller or honest in his recounting of the incident to all he has complained to about it, though, on the off-chance he has run across a litigious attendant.

I do have another suggestion.

Perhaps Ryan should charter a private jet and hire his own staff in the future.

I just flew to Vegas and back on American and was pleasantly surprised at the courtesy and service of the airline. Even TSA was very easy to deal with. Security in Vegas was less than 20 minutes line to exit. I just thought this thread deserved the other side of AA.

Maybe they will give you double or triple bonus miles
A few years ago, my wife opened a new jar of applesauce and found a coating of mold on top. She called the company's customer service number to let them know - just to inform them that the particular batch of applesauce packaged on that day could have been sealed improperly.

We received coupons galore a few weeks later, good for free applesauce.

There is a reason company's have customer service numbers. If you report an experience or an incident as a consumer service or with an honest complaint, the company is interested in hearing from you. They (generally) want to provide good service, produce a safe product, make a customer happy. I think thoughts or threats of lawsuits over life's minor irritants, however, are just plain silly.

I'd really like to know how Ryan was financially damaged as a result of the ill-mannered flight attendant's actions:rolleyes:

No, I really don't.:D
