does a tenant have a right to come and almost knock your door down and yell and scream at you? how long of a notice do they have to give you i am in wv

cause i was scared of getting evicted i mean this person has pulled guns out on the other tenents and shot peoples windows out and the landlord said today if there is any more trouble he was going to ask us both to leave. the neighbor can come and go and slam his doors and stomp up the steps and nobody is suppose to say anything can the landlord evict us for that i mean if we were having parties and stuff like that i could understand the neighbor getting mad but its nothing like that. so can they evict me for calling the police cause the landlord did say if anything else happened he was going to make us leave

The answer is still the same if you have no lease

the landlord will give you a 30 day notce to move....

with a lease you could possibly withold the rent until the lanlord evicts the neighbor

well what would your advice be about the neighbor cause its not like i can hold my kid down and make him be quiet and why should i be so worried about them when they are not even worried about me. i mean i know its not right for him to come and bang on our door and yell and scream at us is it? i wouldnt think so. so you are saying that the landlord could evict us if we were to call the cops on the neighbor. cause its not like we are being really loud i mean there are no partys going on here or anything like that. so would you suggest we just move on our own cause i know the neighbor will come over and do this again no matter how quiet we are thanks

IF YOU HAVE NO LEASE YOU HAVE NO RIGHTS

if you have a lease you have some rights to demand the landlord either solve the problem or let you out of your lease with no penalties.

dj1 is correct on both counts. You don't get it and your the problem, not the solution.

After careful reading and review of all the postings on this topic you have placed, the noise, whatever type of noise it is, is coming from your unit.

You stated something about a kid making this noise. Therefore, YES! It's your job as a partent to control the noise he or she makes within the community living complex your in.

Failure to do so on your part can and will cause you to be evicted. And rightly so.

Noise, especially constant and unwarrantied noise of any variety, almost anytime during the day or nites, is especially aggravating and inconsiderate of others.

Failure to comply and cease the noise is just cause for eviction. You should therefore start looking for a single dwelling house in the burbs. Start packing too.

Case Closed.
