Hello I'm involved in a racial discrimination case against my past employer and today my attorney asked if id like to ask my old job for a offer..he told me he can't say how much I could ask for n I have no idea how much this case is worth..here is the list of complaints..can anyone gloive me some insite on a ballpark figure please.


1. Racial harassment
2. Failure to prevent racial harassment
3. Sexual orientation harassment
4. Failure to prevent sexual orientation harassment
5. Negligent hiring, retention and supervision
6. Assult
7. Constructive termination
8. Retaliation
9. Negligent infliction of emotional distress
10. Intentional infliction of emotional distress

There is no way an attorney would say he can't advise you on how much to ask for, unless:
  1. he is a very bad attorney;
  2. he is not really an attorney; or
  3. he doesn't exist.

he told me he can't say how much I could ask for You can ask for anything you want. Your attorney absolutely should be doing research on what similar claims have been awarded to use as a gudeline on what your claim is worth. If he hasn't done that, you need to tell your attorney to start doing his job.

If your current lawyer cannot or will not formulate a settlement offer on your behalf (based, in part, by evaluating what similarly situated employees have recovered under analogous circumstances in your area), then you have to consider finding an attorney who can do so. There are too many factors (e.g., back pay; emotional distress; strength of the case on liability) and too much professional judgment for the vast majority of layperson clients to make an informed assessment concerning an opening settlement offer.

ESteele, you should have reviewed the OP's posting history before wasting time developing a response. This person probably doesn't have an attorney, and probably hasn't made an EEOC claim.

Yeah, this poster put together a list of how s/he thinks he was done wrong, and now is rubbing hands together seeing dollar signs. The question is so stupid. If OP really had an attorney s/he would not be here asking people to seriously address such silliness.
