On July 28, I hired movers to move me and my fiance's belongings into our new apartment. While moving, the movers broke two legs on my kitchen table. They were supposed to pick it up that evening, but they never showed up or returned my phone calls. On July 30, my fiance called to see why they have not come to pick up the table and the owner was very rude and hung up on him twice. The table was not picked up until the following day. I was told that his shop could not repair it and he had to have someone else do the repairs. I have been promised every week since this incident that I would have my table by "the end of the week". The owner has never returned any of my phone calls because he says that he is "a very busy man". Finally on August 21, my fiance was told that the table was ready and we would receive it by the end of the day. At 5:45 he called him back and he said the table would arrive in our apartment in 30-45 minutes. The table was not delivered and as this day, I still have not received any phone calls from the company. On Ausgust 23, I filed a complaint with the better business bureau, but have not received any response yet. Should I wait to receive a response from BBB or should I start the paperwork to file in small claims court to replace my table? I'm not sure how much longer we can go without a kitchen table to eat on.

Contact him one more time (best in writing with copy and reciept of delivery). Tell him that if you don't have your table back by ________ you will be filing a claim against him in small claims court (assuming the entire move was in the same state) and then he will have to pay the damages, PLUS court costs.
