I rented a house in santa cruz about 8 months ago...7 is closer....the house was still in probate when I moved in, the landlord stated he could not sign a lease before it was out of probate. But Work was calling, it was near the school we wanted, it was priced in such a way, @ 1500 the first year, then the rent was to go to 2500 the second third and forth....the house needed work, I'm a contractor...we made a deal where I would do the labor, landlord would pay for the material...I would fix the house up the way my wife wanted it.....everyone would win

I had two men and myself the first month, just fixing the place up, I spent near 2000 in materials, not to mention the labor....I estimated the overall project in the 60 K retail area....long story short, while still making my piont...
he did not reimburse the money I spent, when he brought me the lease to sign it had the four year terms we had agreed to, then it said month to month on the bottom of the contract.....
NO way was I going to sign that, not mention he had little items in the lease like, if there was ever a problem, and I could not get ahold of him I had to pay the first 100 dollars for repairs..? that if his taxes went up , my rent would go up in sync. all B*&^%$$%.....
so I wont spend any more money on materials....less he delivers it....( he would not reimburse me for milage either.

So I told him you bring the materials I will put it in....needless to say....none ever came....so I make my payments on time every month....but nothing getting done on the house and I am still paying 500 dollars a month for storage...I am bitching about the shape of the place....email me I can send picts.....I finally find out, that becuase he doesnt have a application on me, or a signed lease....he somehow goes and runs a back ground check on me....no big deal....I do have a felony on my record but its 24 years ago, and a class three non violent drug charge.....but,,,,wait he cant check my credit.....look at pricvacy dot come.....

anyway I get served fiill out my answer on the ez file system and wait to hear back from the court...have my little tracking number all the good stuff....

turns out the ez file doesnt really file...so 7 days later they default me...I was able to get that truned aorund, set aside...new hearing...I broke my hand...so cant drive, bus strike going on in Santa CRuz....

go to legal aid, in that I dont have anyincome while my hand is broke...and my case is so freaking solid...I can get by with legal aid...

guys serves me becuase I am bitchen at him to get this stuff done, my rent goes up 1000 bucks in 4 moths the house better be finished out....and the shower and windows dont meet code ( not even close) floors dont meet code....there is some work to do to this bad boy.....

I finally send him a notice That I am going to retain counsel...I get a thirty day notice....have all the emails to prove everything...photographs,,,I got it nailed...
two days before court the legal aid attorney tells me she will not be in court on thursday

Gives me 48 hours to study up for the hearing...I seardh for a lawyer, but with only one day before trial....SO I go in and ask for an extention so I can retain a lawyer...note it 7 days between getting the default set aside and the unlawful detainer....

I ask for the time he says no...the trial goes on...no withnesses....but I have my wife and I...and alot of the paper work...but not all...
I loose....

I give notice of appeal, and file the paper for a stay on monday...

never behind on any payments, paid money into the court where I am current up to wendsday....have a child, and just got my hand out of a cast......

question one...why did he not allow me the extention...when status quo would have only served justice, money was offered for daily amount paid to land lord, My attorney is not present....?
does anyone have any experience with appeal? tips

thanks for the long reading session.....thats as short as it gets...there is a lot more...the house does not come close to meeting basic standards...
no deadbolts, floors are horrid....down to the substrate in some areas...big mess in the back yard, plumbing problems...electrical not to code....Area around bath window sheetrock missing, one electrical outlet in the kitchen.....no locks on the windows,,,vinyl floors faded, peeling curling......hole in the cieling where the wood burning stove vent went.....mold on walls in lower section of the house...plywood on stairs rotten, gives when you step on the stiar...no rail....peeling paint...
he never gave us a lead paint warning...1960 house......my wife is takeing a sample in on monday to determine if it contains lead. Most like ly does,in that it is original to the house.....driveway is so steep that you can not get a car up it....really
