I live in Louisiana, and if i was to seperate from my husband and the only place i could go was to another state, which would be in Mississippi so my mother could help me out cause i currently am a housewife and mother of two and have no income. Would I be able to take my children out of the state? My mother lives approximately 150 miles away. The reason i ask this question is cause i know that my husband would try to fight it.

My response:

Until there's a court order saying otherwise, you can take your children anywhere you want, at any time you want. Remember, so can he.

Also, be aware that if he files for divorce in LA, and you haven't satisfied the "residency requirements" for MS before he files, then expect to go back and forth to the courthouse in LA during the pendancy of your divorce litigation.

Before you do anything however, I really would suggest that you obtain a consultation with a local Family Law attorney. Most give FREE initial consultations. So, get the full facts before you do something you shouldn't - - just in case.
