I am soon to get a divorce and I love my kids more than anything in the world and I know she cares for them also. I am not asking for 100% custody I just want them to live with me. 50% 50% is fine and I don't need any child support. Where as she wants child support for all three kids and wants them to live with her but I can come see them whenever I want. What are the determing factors and do the women always get it there way?

My response:

In California, I can assure you, women do not always "get there way." If all things are equal, you'll be awarded 50% custody, with her having residential custody. If she works, and the court orders 50% custody, no child support will be awarded to you, or her.

However, be aware that if she doesn't work, or you make more money than her, child support will be ordered in favor of the residential parent.

More and more Judges are awarding 50/50. The father has to have a very good attorny. The constitution is to give equal treatment to men and women right? Why is it that the courts dont automaticaly give 50/50? Why do men have to fight so hard to see their kids? Typicaly women are the ones given custody, why? Because they are the mom? Women dont have to prove they can care for the kids, but men do.

All this is speaking generaly, when there are no outstanding circumstances of abuse, drugs, etc.

I am a nobody, I dont know all the rules and laws but why cant it be more like this(?):

Automatic 50/50. The lives of the child(ren) be kept as close to possible as if the parents were still together. Parents should be required to live as close together as required for the kids to attend the same school as they do during the marriage. If one parent moves beyond that, that parent forfeits their share of the 50/50. That parent then gets the every other weekend visits.
