My State is California
Here is the case. I work for this big company. ANd we have a employee performance evaluation that is done mid year and yearly. The scoring system is out of 7. If your score is 3, that means you just met the objectives. Anything from 4 to 7 is over exceeded expectations. For 2005 I have a 4. 2006 a 5. and 2007 a 6. So it shows that im improving and aggressive. I am also a pacific islander. I have performed over 35 projects in the last 3 years. Prior to coming in the company, I had 2 years from somewhere else. And before that 6 years. The industry I work for is electric utility. In total, i have about 10 years of work experience, 4 years in the utility. So I get hired in as a level 1 in 2005. My supervisor tells me that my previous experience at the previous utility doesn't count (2 years lost) so I'm coming in like someone who just graduated from college (with 2 years of industry experience in my head). So then 2006 rolls around and I get a score of 5. A bunch of people got promoted, even people that came in the same time or after me. I get pissed so i decide to keep my cool and give it some time. Then mid year 2007, I get a score of 6 and I asked the supervisor if I can get a promotion and i presented all the work and good performance that I did in the last 2 years, he says "it will be a surprise". Then I talk to the director and bring up my case, he said he will look into it (He's white). Then i told him I will get back to him so i decided to wait till the upcoming March (when promotions, bonuses, and raises happen)Then December comes along and all these people but me got promoted. I get angered. I send an email to my immediate supervisor asking him why i didn't get promoted and i laid down all the facts why i think i deserve a promotion. He ignores my email and ignores me in person. A week later, i send a follow up telling him "out of courtesy, i expect a response to my previous email". Then he calls me in and tells me how the promotion works. He says that there are numerous factors in promoting somebody like budget, performance, the need for promotion etc..the same balony **** answer he gives to all those other people that are having similiar problems like me. Then i passed the state exam and became a licensed engineer in my profession for the state of california. I just passed it this january. Now march comes along where people get promotions and raises. I got a big raise but am still a level 1. Then other people who came in the same time as me or after got bumped up higher than me. I am beyond pissed. I want to go to HR and the EEOC and have them investigate. I dont have a case for racial discrimination since my boss is white because other colored people get promoted but now i think he's discriminating me as an individual what else could it be? I send a follow up email to the director about my case and laying down my facts, I haven't got a response, its been a day. Im still a level 1, i have ample proof that i meet the qualifications for the next level, I want them to prove to me why i dont deserve the promotion, what do i do next?
