I was recentaly convicted of minor in posession. I attened a school dance. I was with 2 other friends. One of which was drinking. They administered a field sobrity test involving the vertical pen test. The first one I passed. My friend that wasnt drinking passed as well. My friend that was drinking failed. A school official escorted me and my friends as they search each of their cars (I was not driving), they found nothing. As we went there I asked why I was being held there. He responded 'Just to make sure the police officer is done with you.' We were put into seperate rooms for questioning. As the police officer walked into the room I again asked why I was being held there. He responded, 'You sound like an attorney.' as he got up in my face. He administered another pen test. He said I failed, However I notice that that time the pen test took a lot longer. He talked with me more and about 10 minutes after we had been in there he let my other friend that hasnt been drinking leave. He spoke with me for about 20 more minutes, he then called my father. A uniformed officer then came and admistered yet another pen test. I failed with '5 clues' he said. They kept trying to get me to admitting to drinking and I kept repeating that I havnt consumed any. My father came and I recieved a ticket for Minor in Comsumption. I beilive that this is wrong. My school automatically put me in JJAEP. My main concern is being put into JJEAP because I am enrolled in speacilty hands-on classes. Is this worth fight? What are my rights? I would like to settle this with causing the least amount of trouble possable. Thank you for your time

Also I would like to know if there was anyway I should have handled it differentaly. ie: Run. Just leave. Refuse the sobriety test.

I also understand this is a Drunk Driving section, I just thought that this was the most appropriate place to post this.

1) you should have handled it differently by keeping your big mouth shut and just follow directions without arguing with the authorities.

2) see #1 above.

I didnt argue with him. I just asked if I could leave. So do you think this is a battle worth fighting?

It is worth fighting if you have good grades, have not been in trouble before and are considered a model student. You are also judged by the company you keep so if your gang of friends are bums and always doing bad things and possibly getting into trouble, that will be a reflection on you.

Well, I make a's and b's, I attend a specialty school, where I am the 2nd smartest guy out of our whole town (amarillo). My friends arnt notorious bad students. How would I go about going agaisnt my school with the JJAEP.

Have your parents contact and attorney and you, they and the attorney have a meeting to discuss options.

By the way,
I decided to plead guilty. I figured this would make me look good if I took responsibility for my actions, rather than making a big scene
