What is the name of your state? What is the name of your state?Indiana

My daughter's father wants to emancipate her, she is 18 years old now will be 19 in March. She has started college. He owes over $13,000 in back child support on her. He has never really had any kind of relationship with her, as he has been in and out of trouble all her life, we were never married nor does his name appear on her birth cert. Can he emancipate her? We have a court hearing on the emancipation Friday Feb. 18. Can someone please help me. I have no idea what to say or do when we are in court.

What does he think emancipation is going to do for him? He's still going to owe back support.

The order states he is to pay child support until she is 18 or is out of school (including college) or she turns 21 which ever comes first.

And what does he say in the motion he filed about why he wants her emancipated? And has he ever been found in contempt for the back support?

I havent seen anything in the motion, just says he wants to emancipate her. Yes he has been found in contempt, but nothing was ever done, I have filed another contempt with the courts, $13,000 is alot of support to be behind, he just has no clue what raising a child is all about, yes i know it took two, but he should step up and be a man about this, instead he is running away from it. He wants to try to get some if not all of back support takin off, do to he was in serving time, does he think the world stopped, just because he was locked up? Sorry I was venting.

I wouldn't worry a great deal, to be honest. Simply point out that the child has graduated HS (or will in June) and is going to be attending college. The order states that he will be responsible for helping supprot the girl until 21, and you feel that he should be held to that obligation - as well as repaying the back support.

Good luck.

SD, you are in the right here; don't negotiate this away. AND you got the correct answers!

One more question, Can they order him to pay back support within so many days? I have heard they can. I will update you on the out come. Thanks so much.

Q: Do I ask for this for it to be paid in so many days?
A: Ask for whatever you want, when you want it.

Just found out the father is out on bond, question: can I ask for a lean to be put on the bond for back child support? ( even if someone else paid the bond, like his mother?)
