I have a friend that is going to be 20 in April that is currently a LCPL in the Marines. He is stationed in North Carolina. And I know is currently dating a girl who is 15 and wont be 16 until the middle of June, She is in West Virginia. I used to be in the ARMY and I remember that there used to codes that we had to follow for fratranizing and what not. Plus I need to know if something could happen to him and he could get into trouble. I do not know if anyone else knows how old she is or not or even if they know that he has a girlfriend. Please help me and if he could get in trouble give me some exact facts so that I can pass them on before anything bad happens. Thank you from Washington

N.C.G.S.A. sec. 14-27.7A states that it is a class 'C1' Felony to engage in "sexual relations" with someone 13, 14, 15 years old if the defendant is at least 4 but less than 6 years older.

In other words, your friend may be looking at a class C1 Felony. It doesn't sound like mistake of age is an issue, so I guess it depends on precisely what your friend and the girl have been up to.....

Does HE know that she is 15?

If so, and if he has sex with her, he can be charged under the UCMJ -- the age of consent in the military is 16.

If I may add

UCMJ 920.ART.120

(b) Any person subject to this chapter (yes he is) who under circumstances not amounting to rape, commits an act of sexual intercourse with a female not his wife who has not attained the age of sixteen years, is guilty of carnal knowledge and shall be punished as a court-martial may direct.

So I guess its ok though for a female marine to bang a youngster but not the other way around?

My response:

I'll stay quiet, and keep the laughs to myself!

LOL, I was thinking the same thing litigation. There is a difference between not being judgemental and this.

How about this nugget of free advice....I know he thinks she's "real mature," etc...how about j/ tell your friend to stop having sex w/ kids....???WTF man? What a loser...he's gotta go a few states over to find some CHILD to molest? He's your friend? This is acceptable to you?

Isn't it ironic how only a few of us reasonable members have pointed this out, yet the internet tough guys who nail these awol kids to a post have nothing to say. Pathetic.

Everyone got the humor in it buddy. Some just tried to show some restraint in taking advantage of an easy laugh.

Perhaps a class in Tact 101 might be useful?

I was Duty NCO in NC/1996 and while ‘doing the rounds’ at the barracks, a civilian girl walked past, after stopping her and ensuring she had signed in the visitor’s log, I went on about the day.

Turns out the girl was a run away living in those barracks and was 15, if I recall a Sgt Majors daughter or the like. Well, not 1,3, or 5, but several Marines were having relations with this young girl.

They are all now civilians discharged with bad paper.

The girl looked 30. It’s the dang baby formula!

I still know one of the marines and will actually see him at a Super Bowl party this week.

The point is that although we all know being a single Marine LCPL is a very desolate, lonely, andunthankful life, he needs to cease and desist.

And can I just say what is he thinking? Morality aside. A 15 year old girl has the maturity of well...a 15 year old girl. When he shows up to Freshman Prom in Blues she will spill the beans to daddy and this guy is going to sing-sing.

Tell him to read this board. Ask for me. And I’ll hook him up with a Marine who can outline the hardship he will face in the ‘real’ world from bad paper.

And if the slightest chance you are that 15 year old girl, this guy is taking advantage of you. Go be a kid. Have fun. Leave that crap and stress for years from now, they’ll be plenty of it.

More to the point, this guy is likely to either get: A) shot; OR B) forced to marry her when daddy points the shotgun at him, in between spitting out his chew'n tabacky. Ain't ya herd, if she ain't good nuff fer her own family, she aint good nuff fer nobody nelse either.

OK, no more making fun of my in-laws.

But yeah, the military repurcussions are bad too.
