Last year by December I went to the Office of complex apartment where I used to live to give my 60 days notice. According to my contract I had to notified them 60 days before I move out. (It was actually almost 80 days before when I went to sign the paper work) In an effort to keep me as a tenant (I lived in the same apartment for over 10 years, never a payment late, never a single problem) they told me that they wanted to accommodate me into a bigger apartment with tile instead of carpet (one of the major reasons why I moved out) they told me to come back in a few weeks. So I did. Back and forth they hold me with lies for over a month, until I got tired and I went back to end the situation. I found that they could not accommodate me, at the end, anywhere and they made me sign another paper of vacation. (by this time the date on the second paper was only 56 days before the end of the contract)
so when I moved I only received by mail to my new house a $ 30 check for my deposit (about 60 days after my contract expired) with no explanations whatsoever!. So I called them, the reason was that they claimed that my deposit was held because: 1. non sufficient time of noticed (60days). 2. Damage of carpet (after 10 years!!! what they expect!!!!? regular tear and wear!!) 3. Unpaid water bill (they pay the water for the tenants, as far as I was concerned my account was paid in full before I moved!!!).
So I send them a letter requesting my money since they failed to notify me within 30 days that they were making a claim over my $840.00 deposit. After a few weeks they send me back my money with the difference.
All was good until recently I started to received notices from a collection agency claiming that I owed them $800.00. after I replied to the collections agency saying that the “landlord forfeit the right to impose a claim over my deposit (under Florida State Law. Florida's Landlord/Tenant Law
Summary of Chapter 83, Part II - Florida Statutes)” I received a letter from a lawyer office saying that NOW I owed them an entire month of rent because I did not let them know I was moving out 60 days prior my contract expired!!!! OMG!!!!!! Can you believe this people?????"
What do I do??? they said that even though they send me back the check with the deposit money the balance on my account does not disappear and I still owed them money (now even more than before!)

what do I do!!!!!!!!!!!!!

If you read my post you will notice that I DID give them more than 60 days norice... they did not want to take it!!! ok??? Thanks

You allowed them to talk you into staying when you were going to give notice originally, so that does NOT count as your notice. Your notice was given when you decided FINALLY to move out.
