What is the name of your state? Florida

I am a truck driver in Miami Florida and I recently quit my job. The company still ows me two trips, and the owner of the company is telling me he's not gonna pay me what they owe me because there's 3 fuel receipts missing from the month of May. There was no problems with the bills of ladings so the company got paid for those jobs, and in my opinion they lost those receipts. can they still hold that money from me? :confused:

One suggestion: Sue them in small claims court.

Stand by for other opinions.

if i was to sue them, would it be better to get a lawyer? or should i file a claim with the DOL first, and try to do everything myself? the two trips amount to about $1500. i talked to one lawyer and they want 1/3 of anything they get from them. so if they don't go to court and settle i'll get like $1000... :confused:

I would definitely go to the DOL, but if you have to sue them you can do it in small claims court so you won't need a lawyer. Do you have copies of your reciepts or other documents to prove you made the trips? You will probably need them for either avenue (DOL or court).

Gotta remember, this guy's in Florida. Hence what purports to be a Dept. of Labor in Florida is does not have the legal mandate to make the employer pay. Small claims court it is.
