I live in Tennessee and my 'husband' in Louisiana. The divorce is filed in Louisiana.
Hello everyone. Well, I have been here before so I'm not sure if anyone will recognize my situation or not but I'll start from the beginning. It's a little messy, you've been warned . We separated June 2010 (we had only been living in Louisiana for about 5 months and didn't even have our own place) I moved up here and brought our children with us with permission. I had to wait 6 months to file for divorce which we agreed would be uncontested me being the main custody and him having set visitation. When the 6 month wait was up I filed and he was served the papers. It had been a couple months and he still wasn't signing and was ignoring me and doing whatever he could to blow me off. His mom had talked him into getting his own lawyer and making it messy. I received papers in the mail for a contested divorce him fighting for the kids and trying to get me to pay child support. I couldn't get in contact with him but I received a text from him saying 'his lawyer made a mistake'. Eventually I got to talk to him and he had moved out of his parents and told me his lawyer did make a mistake and he isn't trying to take them from me and he would have it fixed right away and his lawyer said we wouldn't have to attend court since we reached an agreement and he would go for us. He got put in jail for a couple weeks and his mom started trying to start things with both of us like telling me my husband is lying he is trying to take the kids away and then she visited him in jail and told him I said I was trying to take the kids and get supervised visitation on him and none of it was true I never said anything like that and I talked to his lawyer which confirmed he was telling the truth he wasn't trying to take the kids and he did go to court for us. So in the state of Louisiana it's the law that if you have minor children you have to be separated for a year before you can get a divorce but if you already have been then you can get around the wait. We have been so I talked to his lawyer's assistant about it 3 weeks ago and have been calling her once a week to check on it because my husband never handles his business. Nothing is progressing and I just need to know what I can do to make the divorce happen without the years wait. Should I hire a lawyer just to get the divorce changed from a wait to the 'automatic'? And also now more trouble is starting up my husband moved back in with his mom and I haven't talked to him in a week and he hasn't called the kids or me at all and I just talk to his lawyer's assistant yesterday and she said they haven't been able to get in touch with him so I know he hasn't made any changes yet but I'm afraid his mom is trying to talk him into terrible things again, it's not right and I don't know what to do!! What do I need to do? Sorry so long.
