I bought a karaokee machine off of Craigs List under the garage sale section that was said to be in good condition. The seller emailed me directly and said everything worked on it. After I paid for it and brought it home I saw that the CD player was not working. I've tried to get ahold of her for two days via email and threw the phone, but she will not return my messages. Do I have the right to take her to small claims court. I understand that it was only a $60.00 purchase but I still feel the sting of being ripped off.

Yes, you can take her to small claims court. But, how are you going to explain why you didn't test the item before taking possession of it? And, what's going to happen when the seller says that it was working when you took it so you must have broken it?

ETA: Did you lock down the cd player before throwing it in your car? No? Then it's entirely possible that you DID break it.

did i test it first...

when I went to her house it was raining and she was in a hurry to get things packed away. She turned it on for me to show me that it was working and told me that she was showing it to people earlier and that everything was working fine. I took her word for it instead of making her show me that every part of it was in working order, then She put it in a box with foam around it and I placed it safely in my back seat. I also have the original email she sent me saying it worked fine and the response I sent her 3 hours latter when she wouldnt answer my phone calls.

This is worse, not better. You were given (and took advantage of) the opportunity to inspect the item BEFORE buying it. By doing so, and by continuing with the purchase, you acknowledge that it was working when you took possession of it.

You have no case.

ok thanks

ok thanks for your respons I guess next time I'll just have to be a little smarter and remember that no one is trust worthy now a days. I guess its my own fault for looking like an idiot and being so eager to hand over my money.

Its unlikely

I doubt that because I live no more than five minutes from her house and I only had to make one turn at a stop sighn... It is just really unlikely that I damaged it on the way home
