i live in georgia and have an issue with my landlord regarding a fence i put up in the back yard. i have given my 30 day notice and asked him if he would like to purchase the fence. he said it states in the contract that the fence stays and becomes his property. the contract is unclear. it states: "lessee acknowledges the receipt, in good condition, of the entire premises including all appliances, fixtures, furnishings and appurtenances therein and agrees to return said premises and all fixtures, appliances and improvements therein, in as good condition as received". it goes on to state: "in the event lessor grants permission for alterations, lessee agrees that the cost of restoring the property to its original condition prior to alterations shall be considered damages due lessor".
who's fence is this???? please help!

Most rental agreements will have a clause in there stating that if tenant makes any alterations/additions to the premises, it becomes the sole property of the landlord.

YOU bought it for your own personal use, so take it with you, its your fence you own it, you have a right to that fence... In Fact you can even sell it and the landlord cant say a word.....but YOU HAVE NO RIGHT to demand the landlord pay for it.....
