I live in Nebraska, and my 2 girls (ages 7 and 9) are in Illinois. They went for a visit to see their dad last June. We had verbally agreed that he bring the girls back LAST fall for school. He never kept with his agreement. He said he was on probabation and could not leave Illinois. I was in no position at the time to get them. I figured he would have brought them back by now. It has been almost a year since I have seen my girls. I am the one with court papers (filed in Nebraska) saying that I am the custodial parent. My ex had also gotten a protection order, a while back. (against me)Now, his girlfriend is telling me that I am not allowed to have them back.....even for a visit. Mainly because he owes $3,000 in child support. He has not taken any action, as of yet, to get legal custody of the girls. Is it legal for me to go get them myself, as long as I have the papers in my hand?? If not, what can I do?? Also, I make too much for legal aid to help, and not enough for an attorney. Thanks, Charlotte

he he, here is one that is near and dear to me, check out with the local PD, and see what your options are. They should be able to get in touch with the local PD and you could possibly charge her with kidnapping since you have papers proving you are the custodial parent... the issue of child support should be brought to the attention of the FRIEND OF THE COURT or you could call the court system that the custodial papers were filed with. You have a case, as we have checked this one out ourselves. You also can check with the dept that he filed about the protection order.
The biggest thing that you must do is not to have contact with his girlfriend. This is between you and him, not her. Don't let him know what you are doing, and you have a good chance at frying him in court.
The other thing, how did you file your taxes? check with a professional on that one, but if you have the papers and he claimed the kids you have a good chance at getting him into trouble with the IRS too!
