I want to take the builder of my brand new home to court. We built our home and closed in Oct. 2000. A bar with glass shelves was built standard in our house. After 2 months, the supports on the shelves started to crack. The home is under warranty for 1 year, so the builder came and replaced them. 6 weeks later the entire shelfing system fell down, and $3000 worth of crystal wine glasses, champagne flutes and decanters were broken. I have a witness, the sub-contractor they sent to replace the glass, who confirms the design was poor. I have tried to settle with the builder and they have refused. My homeowners insurance refuses as well. My county limit on judgements is $1000. The clerk says I can file in the civil division of general district court for up to $15,000. However, my builder is incorporated and they will be required to have an attorney present. I will not have an attorney.
My question is, do I have a case? Do I go for the small claims court for $1000, or do I stand a chance going for the $3000? Please help! Thank you.
