I was charged off 10 years ago for a credit card debt with Amex. Now, there is a collection agency from N.Y. that wants the debt paid off in 30 days. I am in Illinois. What are my rights? Should I pay now or not.
First of all, be sure it is not a judgement. If it's not, the SOL in both states expired long ago. Do not pay anything nor even negoiate anything because you'll reset the SOL clock. If they sue, be sure to respond and site the SOL as your defense.
In addition to Biguns correct post about SOL expiration, you should also read the FDCPA (Fair Debt Collection Practices Act) located at http://www.ftc.gov
It will tell you that you have a right to demand full disclosure of the account attempted to be collected. Knowing the type of debt will allow you to review the SOL issue.
