I was never charged, but the police took my stuff, how do i get it back?

I worked as security for a company. An ex-girlfriend after breaking up with her went to the police and gave details of my involvment of letting friends take merchandise from the store. Without any video tape evidence, or any eye-witness accounts, only evidence of me selling merchandise on EBAY (that was also missing from the store $2000 value total) the police came to my house and siezed ALL of my computer equipment, even one that i had hooked up to my TV satellite. They found only 1 item in my home that was also missing from the store $250 value. The search was over 60 days ago. I was not home during the search (my wife was home). They took ALOT of other stuff that was not on the warrant. I have not been charged yet, i refused to talk to the police as recommended by an attorney. Since i have not been charged, can i get my stuff back? How do i go about doing that without an attorney? How long can they hold my stuff without charging me? Thanks,

The police may hold your items as long as they wish to build a case against you. Even then there is no guarantee anything will have to be returned to you. Even though items taken were not taken from the retailer, if it is shown that procedes from items taken was used to buy the merchandise, you will forfeit ownership of the items. All you have to do is file a claim for return of merchandise with your local police property department. You will have to be specific as to what you want back and why the items should be returned. The items may also be ordered held by a judge and sold at auction to cover any civil claims brought against you by the victim of your theivery. If I was you, don't hold your breath expecting anything to be returned.

Thanks, Xjudge for replying. Everything that they took (computer equipment, etc) was purchased long before any of this stuff went down and i have receipts for all of that stuff. Isn't it safe to assume that the police do not have a leg to stand on? If they did, then would have arrested me when they took my stuff or shortly after. What makes me mad is that they took a bunch of stuff that wasn't listed on the warrant. Since that is considered illegal search and seizure, i will get AT LEAST the stuff that wasn't on the warrant back right? So, how long can they hold my stuff to a case built up on me? Someone told me that they can wait 5 years! That's BS. They have my CPU that has a ton of family pictures from my digital camera that i can't duplicate. That's really all i want back. They can keep the other $3000 worth of equipment, that can be replaced. The pictures of my late grandparents, daugther and other family members are irreplaceable. They even confiscated my back-up burned copies, so i am stuck with nothing!
