I was rear ended on march 13th. I was taken by ambulance to the hospital, x-rays were taken and I was diagnosis was a sprained neck, I was hit so hard my car was totaled. I didn't leave my bed for a week, and for two months after that my neck was sore. I hired a lawyer, and saw his doctor twice over 2 month period, I also saw a physical therapist. My lawyer just called and told me that my cut will be $2200, that he will only pay for his doctors leaving me to cover my hospital visit. He told me that taking it to court wouldn't do anything, that in two years it will still be the same amount. He sent me copy of a letter that he sent to the adjuster stating that he was asking for $18,000 but told me when he called "today" that he was ready to settle for $4500, with my cut 2200. the other parties insurance admitted 100% fault. I think he washing his hands of me, making a fast buck then getting out. I want to fire him but I am not sure if that's wise. I was in a fire 13 years ago.,and spent nine months in the hospital, I am disabled and very very scared. I never sued anyone over this. I need help, what should I do.

You hired a shady lawyer that has his own doctor and is taking half your settlement. And you signed a contract so you can't fire him, you're stuck. If the money you're getting isn't enough to cover your hospital bills, tell him you won't accept and he needs to get more. He can't take the settlement if you don't agree. However, your case is NOT worth $18k and he knows it.

thanks EMC

I'm not looking for a cut of 18k only what is just. I called him and told him exaclty what you said, that 2k it is not acceptable, and I will not settle until all my medical bills are paid. I told him on his answering machine that I'm in no hurry "and I'm not" that I dont care if it takes five years in court. i'm not settling for such a petty amount.

You can fire your lawyer, but you still have to pay him, so you don't really get anything out of it.
