I was swindled into adding someone to deed

I met this guy, dated and fell in love... We decided to get a home and get married. His credit is horrible so I aplied for the home loan. 30 days after closing I had his name added to the deed... Some months after that he gets exposed by his girlfriend that it was all a scheme to get my home... He won't sign off the deed. How can I get my home back?

You need to hire a lawyer and then contact the appropriate legal authorities to see if any of this rises to the level of an indictable crime, and then see if a lawsuit is in order.

About getting married you mean? That is fine, but if that is the case then why isn't he willing to quit claim his share of the home back to her? Its not like he paid for anything or is under any obligation for the mortgage.

Exacty, I am responsible for the mortgage. My name is on all the utilities and I paid for installation, alarm system etc...the ex girlfriend proved via text and photos that she was never the ex. That they planned to swindle me out of the home... He didn't have a change of heart it was a deliberate scheme... now he feels entitled to the home.

😂Thanks I needed that laugh. No my name is Quincy. My fiance found this site and got me started on it. Wasn't sure if I was going to like it or if I wanted my business on here. Are we still talking business...what I call myself for the sake of getting some legal feed back should not be an issue.

How does a home you two "decided to get" suddenly become your home?

Anyway, if you want some experienced help, then explain in detail how it happens that his name is supposedly on the title to the home. That is, explained to me what exactly what transpired after you acquired ownership in your sole name that you claim resulted in his name being now shown as a record owner?

And here let's clarify this business of the word "deed". A deed does not represent ownership. Its an instrument that may evidence ownership, but the word deed and the title (which means ownership) are no synonymous!

So, your statement that "30 days after closing I had his name added to the deed" is legally meaningless as it would not be possible to add him to your deed and impart ownership in his name UNLESS his name was placed on the deed currently with your name and before the deed was recorded. (Which recording would have occurred simultaneously with the recording of the purchase money mortgage.)

Once a deed is delivered and recorded it cannot be altered. So if in fact the county land records show that you are both recorded owners of the home would require that you conveyed to him by a separate deed a partial interest in the home.

Understand that real estate transactions are not like buying, selling and trading automobiles and other movable goods. They are more regulated requiring certain formalities. And often when the required formalities are not followed or adhered to the transaction fails.

So it isn't beyond the realm of possibility that you mistakenly think that he is a recorded owner. But you will need to provide more than simply your conclusion or belief that he is. Understand?
