I normally would abhorr anyone to get welfare or medicaid, but with a life threating disease, it almost seems like a no-brainer

Thats were i would start, try and get our government to pay for you child medical bills

Plus you still have the lease that stated, the carpet was fayed, that should hold up in court, and if your neighbors show up with you in court to dispute having a pet thats good, and they are asking for $1300 for the carpet..is that what this is about? are they asking for any rent too? becuase if it took them 3 months to put in the carpet, you would NOT owe them a dime in rent because they shoulda put the carpet in the WEEK after you vacated. You can aruge that they had someone else rent it for the 3 months and they destroyed the carpet.......that would work.

You post sounding very confusing..as to what they want you to exactly pay for.

I would also consider bankruptcy as well if the persue this, since you will be wiped out by medical bills anyway... not a pretty choice, but maybe necessary.

My son has insurance and medicad but medicals still are high, just life expenses for a special needs kid are, it's a fight for just his rights as a person! so I can't just go out and sue somebody,but I am worried how many people have they done this to?what I am saying in the thread is; I moved out of a house,I received part of my deposit. When I asked for the remainder they said they made a mistake in the homes & would send me another check. Again it was short $80.00, I sent them a 10 day notice asking for my money,I then received a tenant ledger stating that they would refund my money BUT IT WAS GOING TOWARDS CARPET< THIS IS 4 MONTHS AFTER I MOVED OUT!AND NOW I OWED THEM $1,318.00. SO DO I HAVE TO TAKE THEM TO COURT? IS THERE SOMEONE I CAN REPORT THEM TO?
and no, they have not rented the house since I moved out it is still empty,maybe they should be nice to the good tenant they had!

Sorry but this still doesnt make sense..........

Let try this......ok you moved out how much was your deposit?

they paid you how much? and they sent you a check, did you deposit it? did they send you an accounting of the damages and how they figured it out?

#2 you called then and asked for what the $80? then they sent you a check for how much?

#3 now they say you owe them $1318 for what the carpet? did they send you a copy of the purchase? and on what date does it say it was installed?

#4 was any of the money for back rent?

You see each and every little detail is important to get a time line as to what has happened.

If you still have the lease that states the carpet was gfrayed then you would have a good chance to beat this in court, but if you didnt take any pictures of the carpet you may have a problem

Also you can demand the apartment complex find the reciept for when the original carpet was installed many many years ago.

Also did you break the lease? or were you month to month?

It sounds like they are trying to get even with you making a pest of of yourself, for not accepting and cashing the first check they gave you, even if it was $80 short..... right

#1 the deposit was for $815.00. They sent me a check for $522.00 & the charges they sent me were for the wrong house, they said they made a mistake & would send me the rest of my deposit.
#2 the next check was $218.00 sent to me 2 months after I moved out, that is were they still owed me $80.00.
#3 4 months after moving out the sent a ledger showing the would reverse the $80.00 charge & give me it ,but it would go towards a carpet charge & I now owe them $1,318.00. Yes they sent a bill showing the carpet was put in 3 months after I moved out.
Yes I do think there pissed they had to give me anymore then the $522.00. Because most people would have sat back & said what can I do.Which is why I did a walk through with them after they said I did not need to be there at the time of walk through & I said I wanted to be there! Yes I want to turn them into every goverment agency or company I can because now I'm pissed that they get away with this stuff. I wonder how many times they have pulled this crap?

Like i said you have to sue them in small claims court for the $1300+ and let them prove to a judge they deserve the money.

You did a walk trhu, you have a lease that states a frayed carpet, and if it was so bad it WHY did it take them 3 months to put new one in, so you can say they had someone else renting the apartment for those 3 months and they destoryed the carpet and let them prove otherwise...

Sounds like it would be worth your time to learn about our court system and how it works in America.

This is completely off the subject of your post, but, here goes...you have a special needs child. Are you recieving SSI or any of the other governmental services allowed? My brother is special needs(not severe) and on medicaid, and he's not had to pay a dime for medical expenses since the day he started it(that includes dental and prescription). Have you looked into finding a regional center in your area? There are agencies, funded by the government, that will pay people to do all of the paperwork for all of these services. Are you signed up with any of these? If you are recieving these things, good...if you're not, GET THEM IMMEDIATELY.(just so you know, once you're with an agency, they will even find an attorney to handle something like this for you pro-bono, depending on where you're at) Hope things work out for you

Thanks for your help. I have found a place called Renters Rights that has been very helpful in helping me get started.
Also Lildevil 719 Thank you for your thread,it is nice to her someone offer some kind of help with my son. I feel no one has no idea what I am going through losing my only child, and very few people offer what they know. It's like pulling teeth in this state to understand whats avilable. Felicia, all you have to do is go to the social services department, and they can tell you where to go from there. If they can't help, they'll know who can. There are so many services available to people in your situation, and it's true that it's hard to find out about them...you just need to know who to ask...I do understand where you're coming from, being co-guardian of my brother, who has a developmental disability. Trying to find out what you and your child qualify for will be hard, and the paperwork will be even harder, but trust me, it's worth it in the end. So, good luck...
PS...look around for places like independent living centers and supported living programs. These won't come into effect until your child is an adult, but you need to get him(her?) on as many waiting lists as you can as soon as possible(the wait for those kind of services can be up to 20 years)
