Follow up to my motions:
I've asked the court to delay my case, so I can file motion for verify complaint. After the court has granted new trial date, I went down to the court in Laguna Niguel and attempted to see the court clerk, but I was stopped by a deputy sheriff. I showed him my notice to appear and told him I need to see the court clerk to file the motion. He informed me that, since this is a notice to appear, I can't not file for the motion,and he told me to wait for my court appearance before the judge.At that time, when I plead not guilty,and given new date to appear, then I can file for motion to verify before my court date.
IAAL, is the info he gave me correct ?
He would not allow me to see the court clerk, is there away I can file this motion before then ?

Please advise.

My response:

The officer is apparently overstepping his authority. His authority is to keep order in the court, not act as a court clerk. However, there's more than one way to skin a cat.

Mail an entire original, signed and dated, motion to the court clerk, with a copy of the first page (for conforming) along with your $23.00 filing fee, and a Stamped, Self-addressed return envelope. Write a cover letter to the clerk, with instructions to file the original, and conform and mail back the copy.
