Hello stranger,
I bet you thought you'd heard the last from me!

Well, I am a "mere" 12 days away from my settlement hearing...
and I have a question - I was told by a fellow accident victim, that I should have a journal that basically details all the trails and tribulations that resulted from my accident.

Is it a little too late to put one together now? I can remember the details and a majority of the crap that I had to deal with but since this is just a mediation hearing and not an actual trial - do you really think it will help?????

After just going through my arbitration last week, i would say a journal or notes would be a great asset to you and your case. It was something that i had used to "fall back on" whenever i needed to refresh my own, or a witness testimony or just to review...Aloha and good luck...

Hello, Haley! Nice to hear from you. Apparently, Hawaiian Mark got to you first.

Anyway, you might want to write down a few notes for yourself, but to create a journal at this late date? Not really good. Why? First, if the mediator asks if these notes are "contemporaneous" notes, then you'd have to say "no" and they will be give no weight. Second, the handwriting and penning will all look the same, as if you wrote everything all at the same time (which would be true). And besides, it would be difficult at best, if not impossible, to say things like, "On April 5, 2000, was feeling low back pain in the morning at about 9:00 a.m. - - couldn't take my morning jog" unless, of course, your memories are photographic.

Just make yourself some generalized notes about your pains, your medical treatments, medications (what you took, how often, along with starting and stopping dates), and restrictions from your normal daily living and activities.

This is really something that should have been started from day one to be of any real use.
