If a hospital ask you to write a letter describing your complaints to the Insurance and Claims Management department.....does this mean you have a good case.....or is everyone asked to do this if they have a complaint with a hospital?
This would be giving the malpractice carrier a free shot at you, and what you say can lock you into a story that while it may be totally accurate, may leave your case open to interpretations in the legal world that may be used to your detriment.
You could be a very nice person and say something that gives an out for what was done, or that could shift blame.
I know how stressful this can be, but if you haven't gone through this before I would definitely be seeking legal advice, and definitely seeking to have anything you write reviewed before you let others read it.
As to a settlement now, versus 3-5 years and as to a settlement without an attorney those are monetary issues that a calculator can help you better make a decision.
But example. If a person negotiated a $40,000 settlement on day one, but an attorney could get you $100,000 after 5 years. The attorney may get 40% plus expenses so that taking the settlement on day one, while much less for the defendents could be much better for the claimant. Plus you have he settlement done immediately.
