What is the name of your state (only U.S. law)? La.

For over 8 years, I've never had a child support order on him. I've never asked him to pay at all. Is there a way I can get back pay on those years, or do I have to start fresh right now?

First question: is he legally the father?

yep, he sure is. I hate to do something like that to him, make him pay all that back support. But, he sure doesn't mind me having to pay super high lawyer fee's every time he decides not to give the kids back to me. We have joint custody right now, and he won't give them back.

No, you can't get 8 years of back support if none was ordered. You can, however, petition the court for a support order now and they will decide with the custody arrangement if one is warranted.

You have legally established JOINT legal/ physical custody and no ORDERED child support of either to the other?

You CANNOT get "back" child support because there is no "back" Child support. He doesn't owe it to you, nor you to him, if it was not ordered.
