If my husband and I were killed in accident, would my 13 year old step-daughter inherit all assets if we do not have a will?
If my husband were to pass, would guardianship of my step-daughter go to me or would I have go through custody proceedings to keep her?
Are there special attorney's that deal specifically with custody type wills?
I mainly want to make sure if something were to happen to us her mother wouldn't get her hands on anything of ours.

DEAR JEWELE:

Yes, your 13-year old daughter would inherit all of your assets (if she is the only child), but you still need a will prepared (so there will be an official record of your wishes) to name a guardian to take custody of her and manage her assets until she becomes an adult.

You may or may not have to go through custody proceedings, but you at least have to name a guardian in your will.

You don't need a special attorney other than a probate/estate attorney, but a family law attorney could also advise you about this matter.

All of the questions and concerns you have can be taken care of with a properly prepared will.
