If tenant changes the locks

What is the name of your state (only U.S. law)? va

If the tenant changes the locks and the landlord no longer has access to the home (because he doesn't have a functioning key) can the landlord (after providing notice to the tenant of landlords intent to do so) simply hire a locksmith and change the locks in order to acquire a functioning key to the home? if so, how much notice needs to be given in order for the tenant to comply (30 days?)? and if not, what would you do? start eviction procedures?

Notify the tenant (in writing) that they must provide you with a key or you will be hiring a locksmith to change the locks and such services will be billed to the tenants.

If you do change the locks, provide your tenants with a new key.

Thanks for the advice Gail. As always the advice you provide is very helpful (I enjoy reading the threads and reply's on here in order to be more informed on landlord/tenant laws).

When you send them the letter consider sending it via certificate of mailing , its very low cost , it will give you a receipt that will have a cancelation mark showing to whom you have sent the letter (since you fill it out) Also feel free to remind them your having a key is more about reducing damages that can rise from a emergency repair such as water pipe that breaks or storm damage or at worse should they go even on a mini vacation and it is broken into police would be contacting you and it will make it easier to secure the property if you have access. ( offering positive consequence of your having access) BTW at least call local locksmith and learn about the cost of tamper proof locks , locks where a tenant cannot just easily change them. ( inc keys that are stamped with locksmith shop name and do not copy )

Thanks Farmer. Yes, I always do everything in writing via certified mail with return receipt (just to cover myself).

Great idea about the tamper proof locks. I've never heard of that and will definitely look into it before renting out my place.
