Yesterday the foreman on the job told me he and the rest of the crew (7 guys) were illegal aliens. He told me that they haven't been paid in 4 weeks. I asked him if he received a 1099 or W2, whether he was a contractor or a employee. He told me that when they do get paid it is in cash. The fact that they are illegal and paid in cash didn't sit well with me but they are realatively nice guys and I didn't want to make waves.

However after realizing that they wouldn't be covered by Workers Comp insurance I called my property insurance agent to see if my liability insurance covers them. I was told that they were not covered and must have them leave the jobsite immediately. I called the contractor and he said "that's news to me." Yeah right... these guys have been working with him for over 5 years. He said that of course they were legal and that he would provide proof that they are covered by his Worker's Comp insurance.

Do I have the right to obtain proof that all of the contractors employees are covered by WC insurance? How would I do that?What is the name of your state?

Did you sign a contract with your contractor? Anything in there about his employees having W/C and liability insurance?

You do have the right to see proof of W/C. You might go to the CA Contractor's state license board and check on your contractor's license and ask some questions.
