Illegal Apartment

What is the name of your state? New Jersey- Jersey City
I let this woman stay in my basement apartment for a couple of months but when I asked her to leave she said no. It was supposed to be for a couple of months it is now a year. i went to courts to file the eviction procedures even though she is not a tenant but she has been there long enough and now becomes a tenant. My court date is for the 24th but in the mean time she got mad at me and went to zoning and told them i was renting an illegal apartment. This is her way of getting back at me. My question is now that zoning knows will they be able to get her out. Or will I have to wait for the eviction date. I just got the notice from zoning and when I called they said they were going to come over and inspect the property next week before my court date and get her out. How does this work?

When you say " let this woman stay in my basement " do you mean that you invited her to stay or that you rented her a room?

Can you reasonably tell zoning that she is an unwanted houseguest being evicted instead of a traditional tenant. What is illegal about the apartment from a zongin standpoint?

Well the verbal agreement was for three months until she got on her feet. You may be aware of my previous posting with the crazy tenant. Then she refused to leave and did not pay me anything anymore. has been in my house for free since. When I got stern she threatened me. Also I then told my neighbors. It seems that she did the same thing three houses down from me and also called the inspectors on them. She has a history of this. I wish someone had told me before i let her in with her sobb story.

**A: hire an attorney or a hit man. If you can find one that is both, better yet.

Thankyou everyone for trying to help me. I am going through so much hard ache for letting this woman stay from my heart. Note to never do that again. She is making my life miserable. Everyone tells me to not think about it but its hard when she terrorizes me so that i cant go to certain parts of myhouse. Like the porch or my laundry room. I just wish I knew how to prepare for the inspector. I know they always think of the landlord as the slum lord but its not like that in my case. I know I shouldnt be scared of this woman and I will try really hard not to be. This is why I waited so long to anything. yes I will admit I was scared of her.

I wanted to give you guys an update. I went to mediation today and she agreed to be out by 02/15/06. I am still going to court for the eviction but I think this agreement she came to with me might help. She kept trying to tell the mediator that I illegaly let the city come in and take the dog. But the mediator told her that I had every right to let them in if I there was danger posed on me in my basement. Which what she did was leave a vicous dog out in the open with her door open. In an effort to terrorize me. I have court next week will keep you posted.

Thanks for the Update. If the dog was truly vicious that was the right thing to do. Did the inspector find if you had a illegal apartment or not.
What was that outcome?

Well, The inspector came and recognized her from a previous illegal apartment. He gave me thirty days to comply. Basically it looks like he cut me a break thank god. I also went to the whole eviction thing today and i went with my attorney who got her to a agree to leave by March 1st so as long as i wont sue her for back rent. To me this is ok because you cant get blood from a stone. My biggest concern was getting her out. Hope this helps the next person.

Questions. What did you have to comply with?

How did your attorney get her to agree to leave? Didn't a judge rule in your favor?

Why a whole month more?

the inspector wants me to remove the stove and cabinets. And my attorney just told her that I had an offer for her to be entered as a judgement. Where i agree to not ask her for back rent but she agrees to leave by a certain date. It gets treated like a judgement.
