We're in NY State. We purchased our house in 1990 from my inlaws; a deed was created in my husband's and my names. In 1998,when my father in law was diagnosed with Alzheimers, my mother in law took all deeds in her and father in law's name and transferred them over to her and my husband's name. With those deeds she transferred, she inadvertently took the old deed from my house in and had that transferred to her and my husband. (The lawyer never checked to see that there was a newer deed filed on the property.)We contacted the lawyer about this error; he claims that it's an illegal deed because I never signed for the transfer of property. Unfortunately, the bank doesn't see it this way and maintains that a new deed must be filed with my name on it. It looks like we're stuck paying for a corrected deed to be drawn up and filed...should the new deed be showing transfer from the correct deed, (would be a transfer from my husband & I to ourselves) or should the new deed show transfer from my mother in law & my husband to my husband and myself? (Bearing in mind that the most recent deed filed is illegal, would that make the new deed also illegal?)
HELP!! I want my name back on the deed to my house!!
