What is the name of your state (only U.S. law)? nevada

my brother was married to a woman in nevada the marriage is not legal and he needs to know if he has to file for a divorce or is it void since it was never legal? He lives in Amsterdam.

Zig raises an important question. Some marriages in Nevada (like bigamous ones) are ab initio void. You don't have to DO anything. They are considered void because they weren't legally entered. Other marriages (underage, fraud, close relations) can be voided thorugh a court anullment process. Others you're going to have to go for a divorce if you want to end.

In addition, where is the "spouse" residing now?
