My wife initiated a mortgage refinace on our home a year ago in NC without my involvement. At the time, we were not in agreement to refinancing so she did this without my authorization. I understand that NC is a joint property state and she would have needed my power of attorney to complete the mortgage transaction. She did not have it and tells me the mortgage company told her to sign my name on the documents to refinance from an 8% to a 12.9% mortgage. This month I was hit with a $6000 prepayment penalty when I refinanced back to a lower rate. Is there any recourse against the mortgage broker for these penalties since they authorized her to sign my name without a power of attorney on the earlier loan? jbshirley
