illegal practice?

What is the name of your state? NY I was wondering if this is an illegal business practice. A sore advertised an item that would be available from 5am-11am. I was at the store when the doors opened, and was infromed they had only 1 of the item, and it was gone. It didn't list limited quanities, they also, do not offer rainchecks. Thank you.

Hopefully I am not propagating a myth BUT I do recall a situation like this in either Mi or Indiana (I live near the stateline and both states are pertinent to me). I recall the states attorney general taking some action against a retailer. Don't know any specifics but believe the retailer had to have a reasonable amount of item available on hand to sell. Otherwise it was considered a "bait and switch" scheme.
