Well I hope that somebody can help me because so far I cannot find out anything. To make a long story short. If I rearend a car in a parking lot but the car I hit is parked illegally in the lane of traffic instead of a parking space. Who is responsiblie for damages? it would seem to me that I would be responsible for mine and He would be responsible for his since he was also at fault. What is the law about this type of situation. There was no police called and no traffic tickets issued. What should I do? I have already taken my car to be repaired and I am going to pay for the damages done to it mainly because I do not want my insurance to increase. Well yesterday the guy who was parkied illegally and wasn't in his car called me after four days and informs me that there was $700.00 worth of damage done to his car. Am I liable for these damages? PLEASE HELP ME!!!!!! This accident occurred in the state of KY.

Yes, you are liable for the other vehicles damage. It is always a drivers responsibility to avoid all road hazards, even if the hazard is not legal.
