I may have asked this question already, but I can't remember or find the post. My boyfriends ex wife is claiming that every year after she gets a copy of his taxes she will take him back to court for more money if he shows a cent more in income. First of all, she gets over $1000.00 a month for one child as it is and thats just child support, it doesn't include the other 50% in activites, etc he's responsible for, which he has NO ISSUE with paying.. Wouldn't the ex have to prove to a judge that why she would need more money? I can't imagine that every year you can take your ex to court for more child support for no reason. The ex is getting remarried and she has plenty of money and goes on extravagent vacations all the time, yet sends the child to us filthy.

No she can't take him to court every year. It's usually brought up for review every 3 years.

There usually has to be a certain % increase in either the income or amount the order would change before they will do a review. Ignore her threats.

Gee, I wonder if she also plans on trying to adjust CS every year if he has a cent LESS income that year?

Believe me. I know its completely ridiculous. He just wants to be left alone to live his life and she's trying to keep that from happening. She's a fool to think what she says has any truth. It is very aggravating, but I just wanted to re-assure him that there's nothing to worry about. There's women out there w/ 4 children who dont get as much as she does for one, and they are struggling. Its just very sad that an "adult" so as herself has to be so sick. I would like to believe any judge that would even have this bs in his courtroom would want proof as to why almost 1500.00 a month is not enough for a 6 year old!

Well that would depend on location as well as if bm is supporting the child. My ex's cs is current is set at 1500 a month. But in most cases 3 years is the period of time where reviews are brought into place.

LIke i mentioned, my main concern was what can she do. She keeps making all these threats. I wondered if she'd have to prove anything. Would her income come into play. She's marrying her boss and we know she got a HUGE raise. My boyfriend has no problem contributing to his daughters life style, but as you can imagine it's difficult when you dont know where your money is going. You pick up your child and she's filthy, her hair smells and her clothes are a mess. I went out and bought her clothes for when she's with us. And the mother lives in a very nice part of town, has a good job, and is having a very big house built in an even nicer town.
