My wife and I swapped cars about a year ago without changing who the cars are registered under. We recently received a violation notice that I did not pay 5 tolls during a specific period of time. The violation is under her name, although I have been driving the car. The violation fee has added-up to $101.They have a picture that a machine took of my car as evidence that I committed the violation.
I can not prove that I paid the tolls, but I know I have paid them because I use this exit ramp at least 3 times a week to go to a Martial Arts class I have been going to for over 3 years. Why after three years of going this way would I all of a sudden stop paying the toll? Also, I am in sales and use the Illinois tolls everyday, paying between $1-$2 a day in tolls. Sometimes I leave the booth before the light turns from Red to Green.
Lastly, three days after I received this notice, I was at that exact same toll booth and the car in front of me kept throwing money into the machine before finally driving away because the light would not change from red to green. I threw my toll in and it did not turn green either.
Is there a way I can fight the state on this? I have a hearing in mid-January. Why should I pay this fine because I either leave the booth before the machine counts it or because the machine doesn't count my money at all? I am one of those people that pays the fee even when you pull up and the Green light is on.
