What is the name of your state? n.c. Lets say a man living in N.C. dies without a will.He hasnt signed any poa pior to his death. He leaves behind a wife, two adult children and 1 grandchild.I assume since there was no will his estate will have to go through probate court that follows nc. state laws.My question is does the probate court appoint someone to be the (poa /or whatever you call this person} over distrubition and collection of the said estate? And is it legal for them to live in another state other then where the deasead person lived or do they HAVE to live in the same state.Does N.C laws on probate apply to person or persons that do not have a N.C resident?Or if the mans wife moved from their home together to another state 1 year pior to his death and no longer had N.C resident can she be appointed by the probate to be over his bank accounts,paY his depts, sale his home and that sort of stuff
