HI: I AM A SELLER ON OVERSTOCK.COM AUCTIONS! I SOLD A LADY A CUSTOM BUILT COMPUTER! ('http://auctions.overstock.com/cgi-bin/auctions.cgi?PAGE%3dPRODDET%26PRODUCTID%3d13103385');
(THE WHOLE TRANSACTION TOOK 11 DAYS TO COMPLETE)BUT ON THE SIXTH DAY SHE FILED A CLAIM AGAINST ME WITH OVERSTOCK AND PAYPAL FOR NON-RECEIPT OF GOODS.
(5 DAYS LATER SHE GOT THE COMPUTER) NOW SHE SAYS THAT IT WAS NOT NEW AND THAT THERE WERE NO LABELS ON THE SLOTS ON THE BACK OF THE COMPUTER.
(I GUESS SHE MEANS THE JOE HOMEOWNER ,PICTURE STICKERS,THAT SHOW YOU WHERE TO HOOK UP THE MONITOR,SPEAKERS,MOUSE,KEYBORD,ECT.?) AND THAT THERE WAS NO INSTRUCTION BOOKLET SENT WITH THE COMPUTER!(I GUESS SHE MEANS THE SET UP GUIDE)(O.E.M. CUSTOM BUILT) BUT WHAT REALLY BOTHERS ME MOST!! IS THAT SHE TOLD ME THAT SHE WAS GOING TO DISECT AND INSPECT THE COMPUTER TO SEE IF SHE GOT HER MONEY'S WORTH
(I THINK I KNOW WHAT IS GOING TO HAPPEN WHEN SHE CANT GET IT TO WORK AFTER SHE IS DONE WITH IT) I HOPE I HAVE SOME KIND OF RECOURSE WITH THIS LADY?? BECAUSE I AM A FAIR AND HONEST PERSON!!! THE COMPUTER WAS A NEW CUSTOM BUILT 64 BIT (IBM) COMPATABLE PC.
BUILT BY MYSELF!(A+ CERTIFIED SYSTEM BUILDER) WITH ABSOLUTLY NO FRAUDULENT, DECEPTIVE,OR MISREPRESENTED DESCRIPTION WHAT SO EVER!! QUESTION:1) DO I HAVE ANY RECOURSE AGAINST HER FOR DOWN TIME ON MY DISABLED AUCTION ACCOUNT?
QUESTION:2) CALLING MY CUSTOMERS+AUCTIONS(DEFAMEING MY NAME)?
QUESTION:3) IF I DO HAVE A CASE? HOW LONG CAN I TAKE TO FILE?

From the Refund Policy Discloser Act, NJ law states,

56:8-2.16. Posting of signs; locations

Every retail mercantile establishment shall conspicuously post its refund policy as to all merchandise on a sign in at least one of the following locations:

a. Attached to the item itself, or

b. Affixed to each cash register or point of sale, or

c. So situated as to be clearly visible to the buyer from the cash register, or

d. Posted at each store entrance used by the public.
56:8-2.17. Signs; contents

Any sign required by section 3 of this act1 to be posted in retail mercantile establishments shall state whether or not it is a policy of such establishment to give refunds and, if so, under what conditions, including, but not limited to, whether a refund will be given:

a. On merchandise which has been advertised as "sale" merchandise or marked "as is";

b. On merchandise for which no proof of purchase exists;

c. At any time or not beyond a point in time specified; or

d. In cash, or as credit or store credit only.

The provisions of section 31 shall not apply to retail mercantile establishments or departments that have a policy of providing, for a period of not less than 20 days after the date of purchase, a cash refund for a cash purchase or providing a cash refund or issuing a credit for a credit purchase, which credit is applied to the account on which the purchase was debited, in connection with the return of its unused and undamaged merchandise.

Despite the wording of the law, having no sign is not a problem. In that case, a default provision of the law provides consumers with "not less than 20 days after the date of purchase" to return the merchandise for a refund or credit."

The site suggests the following for return policy, but you don't have anything on the auction or on your homepage stating return/no return:

"My return policy
Listing your return policy lets buyers know the circumstances under which you will accept returns. It's a good idea to accept returns so that buyers know you are willing to stand behind the items you are selling, but it's also good to limit the circumstances under which you will accept returns to avoid being taken advantage of.
Examples:

- If an item does not meet your satisfaction for any reason, you are welcome to return it within 30 days. Refunds are for the final bid or purchase price only. Shipping costs and insurance are non refundable.
- 7 day return policy for items in original packaging. Shipping is only refundable for damaged merchandise.
- No returns unless item is not as advertised."
