Reguarding an "Agreement Dissolving Parnership" In paragraph 3.04 (a) [Assignment of Interest of Retiring Partener] it states in part...."said parteners have exclusive use of the business name for ten (10) years in said county". Eleven years has passed and ex-parteners are in default. What are my options?
 


I'm not exactly sure what you're asking, but the term "exclusive use" only means that you won't use the same name for 10 years...not that they will stop using it after 10 years. If you want to start another business with the same name now, after 10 years, you're free to do so...providing of course their business isn't incorporated.
